Four Issues You May Have To Address Post-Divorce

After your divorce case is finalized, you may feel relieved that everything is over. Unfortunately, that is not always the case. You will still likely have to deal with your spouse once the divorce is over, especially if you have children together. Changes to Spousal or Child Support 

Either party can petition the court to modify a spousal or child support order if they can show a substantial change in circumstances. If the payer of support can show that the payments have impaired their ability to support themselves, they can petition the court to reduce or eliminate the amount. The court will consider how the party paying support has spent their earnings. If the issue involves child support, the court will also consider the best interests of the child.

Relocation 

There are many reasons a person may want to relocate after divorce. One person may want to move for a better job or they may simply want to be closer to family. This becomes more complicated when a divorced couple has children together. In these instances, the moving party must provide notice to the court 60 days prior to the relocation, or as soon as possible. The other parent has 30 days to object to the move or they lose the right to do so. If the other parent does challenge the move, a court will make the decision based on the best interests of the child.

Child Custody Modifications 

There are reasons other than relocation that can result in a child custody modification. For example, if the custodial parent develops a substance abuse problem or starts neglecting or abusing the child, that can result in a modification. The parent seeking the modification must also show that there has been a substantial change of circumstances. A judge will consider many factors when modifying a child custody order but they are all in the best interests of the child.

Failure to Comply 

The orders issued during divorce are final and legally binding. However, that does not mean that everyone complies with them. If you or your former spouse violates a court order, the other party can take the matter to court to enforce the order. Anyone found in violation of a court order will face serious penalties, including potentially being found in contempt of court.
